Terms of Service

1. General

These General Terms and Conditions (hereinafter: "Terms") govern the contractual relationship between Huszák Richárd János E.V. (hereinafter: "Nissh" or "Seller") and customers (hereinafter: "Buyer") who purchase products through nissh.gg (hereinafter: "Website").

These Terms apply to all orders placed through the Website. By placing an order, the Buyer accepts these Terms in full.

2. Products & Services

Nissh designs and sells custom gaming mice ("Nissh One"). Each product is assembled to the Buyer's specifications using 3D-printed shells, selected internal components (sensor, MCU, switches), and the Buyer's chosen contour and color configuration. All products are made to order.

Purchasing Without Registration

You can purchase products on our Website without registration. There is no account or login system. By placing an order, you declare that:

After placing an order, you will receive an order confirmation email containing your unique order code. This order code serves as your identifier — you can use it to view your order status and details at any time. Please keep this email safe.

The information you provide during checkout shall be accurate and valid. Nissh excludes its liability for any damages in the following cases (non-exclusive list):

Placing an Order

You can design your own product using the builder interface on our Website. You can choose from different internal components, shell shapes, contour positions, and colors — all products are customized to your specifications. To support your decisions, Nissh provides the following information within the builder:

There might be a slight difference between the color of the actual product and the visualization shown in the builder. Nissh is not liable for minor differences between the preview on the Website and the real appearance of the product.

Checkout

Once you have reviewed your configuration and it matches your desired setup, you can proceed by clicking the "Proceed to Checkout" button to start the payment procedure.

Shipping method: The shipping fee is calculated automatically based on your shipping address.

Payment: You can pay with your credit card to complete your order. All transactions are secure and encrypted. We never store your credit card information.

Order Confirmation

After completing an order, Nissh sends you an order confirmation email without delay, but not later than within 48 hours from the time of the order. In case you do not receive an order confirmation email within the above deadline, you can choose from two options:

4. Information on Purchase

Purchase prices on our Website are displayed in Euro (EUR). Our purchase prices include VAT in line with the relevant Hungarian tax regulations, but do not include shipping fees. Shipping fees are shown separately during checkout.

Nissh accepts the following types of payments:

If the issuer of your payment card refuses to authorize the payment to Nissh, we shall not be liable for any delay or non-delivery. The total amount to be paid includes all costs on the basis of your order and the confirmation email. The invoice shall be sent to you electronically.

5. Contract Formation

Orders are placed through the Website's builder interface, where the Buyer selects their desired configuration. The product listing on the Website constitutes an invitation to treat, not a binding offer. A binding contract is formed when payment is successfully processed via Stripe and the Buyer receives an order confirmation email.

6. Design Responsibility

The Buyer selects their mouse configuration from the options available in the builder, including shell shape, finger contour positions, grip mode, and color. These choices reflect the Buyer's personal requirements and preferences.

The Buyer acknowledges that performance characteristics arising from their chosen configuration — such as weight distribution, grip feel, or button reach — are a direct result of their selections and do not constitute defects. Nissh provides accurate descriptions and previews of each option to support the Buyer's decision, but the final configuration is the Buyer's responsibility.

6.1. Bespoke Orders

A Bespoke order ("Nissh One Bespoke") is an individually-specified product that goes beyond the standard configuration available in the on-Website builder. Bespoke specifications are agreed in 1-on-1 communication between the Buyer and Nissh prior to ordering, and are documented in the private quote published at nissh.gg/bespoke/[code] for the Buyer's review.

Because each Bespoke order is built to the Buyer's individual specification, the right of withdrawal remains excluded under Section 8 of these Terms. The Buyer is informed of this exclusion before placing the order and must explicitly acknowledge the bespoke responsibility statement on the checkout page in order to proceed.

Bespoke responsibility: Custom changes specifically requested by the Buyer — such as, but not limited to, reduced wall thickness for lower weight, modified shell or contour geometry beyond the standard builder limits, non-standard internal components, special surface finishes (engraving, dual-color treatments), or adjustments tailored to medical / ergonomic conditions — may affect the structural rigidity, durability, or function of the product.

The Buyer acknowledges and accepts that:

This allocation of risk is permitted under the Hungarian Civil Code (PTK) provisions on contractual freedom and contributory fault, and does not exclude any liability that cannot be excluded by mandatory consumer-protection law (including but not limited to liability for damages caused by intent or gross negligence, or for damages to life, body, or health — see Section 11).

Quote validity, payment, returns: Bespoke quotes are valid until the date stated on the quote page (typically 30 days from issue) and may be renewed on request. Payment is required in full via Stripe before production begins. Coupons, discount codes, and the standard return-credit programme do not apply to Bespoke orders. Production timelines for Bespoke orders may be longer than standard orders due to the individual design and tuning involved.

7. Production & Delivery

All products are made to order. Production times vary depending on current order volume and individual fine-tuning on each design, and are not guaranteed. The Buyer will receive email notifications when production begins and when the package is shipped, including tracking information.

Force majeure: In the event of circumstances beyond Nissh's reasonable control — including but not limited to equipment failure, supply chain disruptions, natural disasters, or pandemics — delivery times shall be extended accordingly. Nissh will notify the Buyer of any significant delays as soon as reasonably possible.

8. Right of Withdrawal

As all Nissh products — including standard builds and Bespoke orders (Section 6.1) — are manufactured to the Buyer's individual specifications, the right of withdrawal under EU Directive 2011/83/EU does not apply, pursuant to Article 16(c) — goods made to the consumer's specifications or clearly personalized. The same exemption is implemented in Hungarian law by Section 29(1)(c) of Government Decree 45/2014. (II. 26.).

9. Warranty (Jótállás)

Nissh provides a 2-year mandatory warranty on all products in accordance with Hungarian Government Decree 93/2024 and applicable EU consumer protection laws. During the first year, the burden of proof lies with the Seller — any defect is presumed to have existed at the time of delivery unless proven otherwise.

The warranty covers manufacturing defects in the complete product, including the 3D-printed shell, electronic components, and assembly quality. Third-party components (sensors, switches, MCUs) are covered under the same warranty — Nissh handles all claims directly and pursues suppliers separately if applicable.

10. Defect Notification

The Buyer should notify Nissh of any obvious defects within 14 days of delivery by emailing contact@nissh.gg with the order number, photos of the defect, and a description of the issue. Late notification does not void warranty rights but may affect the assessment of whether the defect existed at delivery.

11. Limitation of Liability

Due to the nature of 3D printing and custom manufacturing, minor variations in shape, surface finish, and color compared to the builder preview are expected and do not constitute defects.

Nissh is liable for damages caused by intent or gross negligence without limitation. For slight negligence, Nissh is only liable for breach of cardinal contractual obligations (obligations essential to the contract's purpose), limited to foreseeable, typical damages. Liability for damages to life, body, or health is unlimited regardless of the degree of fault.

12. Intellectual Property

All designs, 3D models, software, and branding related to Nissh products remain the intellectual property of Nissh. The Buyer receives a personal, non-transferable right to use the purchased product. Reproduction, reverse engineering, or commercial use of Nissh's designs is prohibited without written consent.

13. Data Protection

Personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). By placing an order, the Buyer consents to the processing of their data as described therein.

14. Dispute Resolution

In the event of a consumer dispute, the Buyer may contact the Hungarian conciliation body (Békéltető Testület) attached to their local chamber of commerce and industry.

EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

If no resolution is reached through the above mechanisms, disputes shall be submitted to the competent courts of Hungary.

15. Final Provisions

These Terms are governed by the laws of Hungary, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Amendments to these Terms must be in writing.
